Terms of Use

 

These terms govern the relationship between you and Captis Heirlooms (Captis Company, LLC) when you book our services. By placing a deposit and engaging us for a documentary project, you agree to the following.

The Service
Captis Heirlooms produces privately commissioned family documentary films. Each project is unique and built around your family's specific story, people, and materials. The scope of every project is defined at the time of booking and outlined in your client contract.

 

Deposit & Payment
A non-refundable $500 deposit is required to secure your place on our production calendar. This deposit is applied toward your total project investment. Your remaining balance is due in full upon scheduling your film date. Production will not begin until all scheduled payments have been received. We accept all major credit cards and bank transfers through our secure payment platform.

 

Cancellations & Rescheduling
If you need to reschedule your film date, we ask for a minimum of 5 days notice. We will do our best to accommodate a new date based on availability. Cancellations made after production has begun forfeit the deposit and any additional payments made to date. In the unlikely event that Captis Heirlooms must cancel or postpone a scheduled film date, we will notify you as soon as possible and work with you to reschedule at no additional cost.

 

What You Provide
You are responsible for ensuring that all family members participating in the documentary have consented to being filmed and included in the final product. You are also responsible for obtaining any necessary permissions or fee payments for locations not owned by you. Any photographs, home videos, documents, or other materials submitted for inclusion in your film should be COPIES where possible. Captis Heirlooms takes every precaution with submitted materials but is not liable for loss or damage to physical originals.

 

What We Deliver
Your completed documentary will be delivered digitally via a private link and on two physical drives. Estimated delivery timelines are shared at the time of scheduling and represent our best projection. Timelines may shift due to production workload or circumstances outside our control.

 

Revisions
Your project includes one round of client notes. This round covers factual corrections and minor adjustments. It is not intended for creative changes to the edit, structure, or storytelling direction. 

 

Ownership & Usage Rights
Upon receipt of final payment in full, you receive unlimited personal use rights to your completed documentary film for private, non-commercial purposes — sharing with family, personal archiving, and private screenings. Captis Heirlooms retains full copyright ownership of the film and reserves the right to use brief excerpts or still frames for portfolio, marketing, and promotional purposes. If you prefer your film remain entirely private, simply let us know in writing prior to your film date and we will honor that request without question.

 

Our Creative Role
Captis Heirlooms approaches every project as a creative partner. While we welcome your input and collaboration throughout the process, final creative decisions regarding the edit, structure, pacing, and presentation of the film rest with our production team. Our goal is always a film your family loves — and we stand behind our work.

 

Limitation of Liability
Captis Heirlooms liability in connection with any project is limited to the total amount paid for that project. We are not liable for indirect, incidental, or consequential damages of any kind. In the event of equipment failure or unforeseen circumstances on film day, we will work with you to find the best possible resolution including rescheduling at no additional cost.

 

Governing Law
These terms are governed by the laws of the State of Texas. Any disputes arising from our services will be handled in accordance with Texas law.
